1. CONTEST DATES: May 21, 2014– August 29, 2014 (“Contest Period”)
NO PURCHASE OF ANY KIND IS REQUIRED.
PURCHASE OF A K'NEX PRODUCT WILL NOT INCREASE YOUR CHANCE OF WINNING.
THIRTY-TWO SEMI-FINALISTS ARE CHOSEN BY K’NEX JUDGES.
THEN, FROM THOSE THIRTY-TWO SEMI-FINALISTS, TWELVE K’NEXperts ARE CHOSEN BY FAN ON-LINE VOTING.
AND THEN, FROM THOSE TWELVE,
FOUR GRAND PRIZE WINNERS ARE CHOSEN BY K’NEX, ALL BASED UPON THE CRITERIA DESCRIBED BELOW, AND NOT BY CHANCE.
HOWEVER, WHILE CURRENT AND FORMER GRAND PRIZE WINNING K’NEXPERTS MAY ENTER AND BE ELIGIBLE TO BECOME K’NEXPERTS, THEY CANNOT REPEAT AS A GRAND PRIZE WINNER IN THEIR GRAND PRIZE WINNING AGE CATEGORY.

2. CONTEST DESCRIPTION:
A contest entrant (falling within one of the four age categories, identified below) must build a unique model design made entirely and exclusively of K’NEX parts (string and rubber bands are not allowed, and neither are pieces from other manufacturers’ construction toy systems, decorative lighting, signage, etc.), without adult or other assistance. Model must NOT contain any portion or parts worn on or around the eye area or face. This includes masks, visors, glasses, earrings, etc. In addition, model must NOT include any “person-weight bearing structures,” including but not limited to stools, chairs ladders or shoes. K’NEX reserves the right in its sole and absolute discretion to disqualify any entry it deems to be in violation of these Official Rules at any time. K’NEX’s decision regarding the disqualification of an entry is final, binding and non-appealable. If your entry is disqualified by K’NEX for violating the specific requirements set forth in this Paragraph, we will notify you of our decision to disqualify your entry, via email, on or about September 17, 2014.
3. AGE CATEGORIES AND ELIBILITY REQUIREMENTS
5-6 Age Category: Child will be no younger than 5 years of age, and no older than 6 years of age, as of May 21, 2014.
7-8 Age Category: Child will be no younger than 7 years of age, and no older than 8 years of age, as of May 21, 2014.
9-11 Age Category: Child will be no younger than 9 years of age, and no older than 11 years of age, as of May 21, 2014.
12-14 Age Category: Child will be no younger than 12 years of age, and no older than 14 years of age, as of May 21, 2014.
4. HOW TO ENTER: All entries must be submitted electronically.
Before an entry may be submitted, a child, or his/her parent/guardian, must register for the Annual K’NEXpert Search at http://knexperts.com. Information required for registration: child’s first name, child’s date of birth, child’s province (for Canadian participants) or state (for U.S. participants) of residence, parent/guardian’s first & last name and relationship to child and the valid email address of his/her parent/guardian.
Submitted models must NOT contain any portions or parts that are worn on or around the eye area or face. This includes masks, visors, glasses, earrings, etc. Additionally, submitted models must NOT include any “person-weight bearing structures,” including but not limited to stools, chairs, ladders or shoes.

5. JUDGING PROCEDURE AND TIMELINE:
Eight (8) Semi-Finalists per age category (thirty-two Semi-Finalists in total) will be chosen by a panel of K’NEX judges, comprised entirely of K’NEX employees from various departments, who will base their decision on their judgment of the originality, creativity, complexity and overall aesthetics of the model, given the age category. Although up to 3 models may be entered by any one entrant, only one model per entrant may be so selected as a Semi-Finalist. In the event fewer than 8 entries per Age Category, the number of Semi-Finalists may vary.
These Semi-Finalist entries, including entrants’ first names, ages, states or province of current legal residence, designated photos of the models, approved names of models and videos of the models (if applicable), will be posted on www.knex.com at 12:00 Noon Eastern Time on October 13, 2014.
The twelve (12) winning Annual K'NEXperts will be determined by an online vote on www.knex.com. Voting will begin at 12:00 Noon Eastern Time on October 13, 2014, and continue through 12:00 Noon Eastern Time on October 20, 2014. Only those who register to vote at www.knex.com may vote. Individuals may register by visiting www.knex.com between 12:00 Noon Eastern Time on October 13, 2014 and 11:59 a.m. Eastern Time on October 20, 2014, and providing an e-mail address. The registration process must be completed by the prospective voter, and accepted by K’NEX, by 11:59 a.m. on October 20, 2014 (according to the main computer time clock at K’NEX), in order for your online vote to be counted. Voting is limited to one vote per day per age category per registered voter from any one email address: so, you can cast 1 vote per day for your favorite entry in each age category (totaling a maximum of 4 votes per day).
The top three (3) entries in each Age Category (see Section 3, above) that receive the most online votes will be selected as the Annual K’NEXpert Search Finalists, subject to receipt of an affidavit of eligibility and liability release from their parent/legal guardian.
From the twelve K’NEXpert Search Finalists selected by the online vote, Joseph Smith, K’NEX’s Chief Development Officer, will select four Grand Prize Winners (one Grand Prize Winner from each of the four age categories) based upon his sole judgment of the originality, creativity, complexity and overall aesthetics of the model, given the age category. In the event that Joseph Smith is for any reason unable to perform the judging, K’NEX shall appoint a panel of three judges made up of K’NEX product design personnel.
K’NEX will then notify and confirm the consent of the parents/ guardians of the potential prize winners. Upon receipt of all written consents, and valid IRS Form W-9 (for U.S. winners only), the final 12 winning entries (four Grand Prize Winners, and eight additional winners), and pictures of the newly judged K'NEXperts that submitted them, will be posted on the KNEX.com web site at 12:00 Noon Eastern Time on November 14, 2014. All decisions made by the panels of K’NEX judges for the thirty-two Semi-Finalists, by on-line voters for the final twelve K'NEXpert Search Finalists, and by Joseph Smith, Chief Development Officer (or his replacement panel, if applicable) for the four Grand Prize Winners, are final and non-appealable.

Checks for winners, and coupon codes for winners, will be issued in the name of the parent/guardian.
The prize winner’s parent/guardian is responsible for any and all local, state, federal and/or Canadian federal or provincial taxes, as well as any other costs, fees and expenses not specified herein, associated with the receipt of any and all prizes.
U.S. prize winners must note that the value of the accepted prize is taxable as income and an IRS Form 1099 Misc. or equivalent will be filed in the name of the parent/guardian of the prize winner for the value of the prize, and the parent/guardian of the prize winner is solely responsible for all matters relating to the prize after it is awarded (applicable to U.S. Winners only). Receipt of a valid IRS W-9 Form is a requirement for the awarding of all prizes to U.S. Winners.
Should the selected Grand Prize Winner be a Canadian citizen, the parent/guardian of the Grand Prize Winner shall receive on his/her behalf from the Sponsor 70% of the total cash prize, as a 30% IRS required non-resident alien withholding applies (K’NEX is required to forward this withheld money to the IRS). IRS Form 1042-S will be issued by the Sponsor in the name of the parent/guardian within the IRS’s established time frame.
Prizes are not transferrable, and cannot be redeemed for cash. Prizes are final, and no substitution will be made by K’NEX. Prizes cannot be sold or traded on auction websites or otherwise, and will not be honored by K’NEX for anyone other than Winners.
Use of prize coupon codes must be fully accomplished no later than December 31, 2015, or the prize will expire and therefore be forfeited.
All tours must be completed by December 31, 2015.
Contest is open to all permanent, legal U.S. and Canadian residents currently domiciled in the U.S. or Canada (except those of Puerto Rico, U.S. territories or possessions, the Province of Quebec, and where prohibited), who are 5 through 14 years of age at any time on May 21, 2014. The children of employees of K’NEX Limited Partnership Group, and/or any of its parent, subsidiary or affiliated entities, its or their agents, advertising and public relations agencies, and the immediate families and/or household members of each are not eligible to participate in this Contest. Entry requires valid electronic signature of parent or legal guardian.
8. NOTIFICATION OF POTENTIAL CONTEST WINNERS:
The parent or legal guardian of potential contest winners will be contacted by email, phone, or fax on or about October 30, 2014. After the notification is complete, a parent or legal guardian of the prize winners will be required to sign, complete and return an Affidavit of Eligibility and Liability Release, an IRS Form W-9 (for U.S. Winners only), and, where permitted, a publicity release, before prize is awarded. All prizes will be awarded in the name of the parent or legal guardian of the winner on behalf of the minor child. If any winner is found to be in violation of these Official Rules, if prize notification letter or email is returned as undeliverable, or if the signed Affidavit of Eligibility and Liability Release and/or a completed IRS Form W-9 (for U.S. Winners only) is not returned to K’NEX within 7 calendar days, prize will be awarded to the next highest scoring entrant based upon the online vote, or the scoring received by Joseph Smith, Chief Development Officer (or his replacement panel, if applicable) in the case of having to select an alternate Grand Prize Winner). Winners agree to use of their name, state/province of residence, likeness and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law, subject to prior approval of parent or legal guardian, approval not to be unreasonably withheld. A U.S. Federal Tax Form 1099 for U.S. winners, and/or other appropriate documentation of prize value will be furnished to, and in the name of, the parent or legal guardian of the prize winner.
Void in Puerto Rico, U.S. territories and possessions, the Province of Quebec, and where prohibited. All federal, state, Canadian federal and provincial, and local laws and regulations apply. By participating in this Contest, each entrant, and his/her parent or legal guardian, on his/her behalf, accepts the conditions stated in these Official Rules, agrees to be bound by the decisions of the judges in selecting Semi-Finalists, by the online voting, and by the decision of Joseph Smith (or replacement panel, as noted above) in selecting winners, and warrants that he/she is eligible to participate in this Contest.
LIMITATION OF LIABILITY:By entering this Contest, winner and his/her parent/legal guardian agree to release K’NEX, and any parent, subsidiary, affiliated or successor entities, and its or their respective directors, employees, officers, and agents, including, without limitation, its or their agents, advertising, or promotion agencies, from any and all liability, loss, action, demand, claim or damages arising from or in connection with participation in this Contest, the awarding, receipt, and/or use or misuse of any prize, or participation in any prize-related activities. Neither K’NEX, nor any parent, subsidiary, affiliated or successor entities, or its or their respective directors, officers, employees or agents, will have any liability or responsibility for any injury, loss, action, demand, claim, or other liability of any kind arising in connection with participation in the Contest, or any prize awarded. This contest will be governed by the internal laws of the State of Delaware. Any and all legal actions or claims arising in connection with this Contest must be brought in a court of competent jurisdiction in Delaware. Entrants, winners and their parents/legal guardians are notified and agree that any claims that they wish to assert as set forth herein must be brought within one (1) year of the end of the Contest Period or they will be barred as untimely.
10. GENERAL TERMS AND CONDITIONS:
Sponsor is not responsible for lost, late, mutilated, illegible, incomplete, garbled, postage due, or misdirected entries, mail or communications, for errors, omissions, interruptions, deletions, defects, or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines, or data corruption, theft, destruction, unauthorized access to or alteration of entry materials. Sponsor reserves the right, in its sole judgment in the case of what it perceives as manifest unfairness, to allow typographical or other technical errors on entries or these rules, to be corrected. Sponsor is not responsible for electronic communications which are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in any entrant’s email account to receive email messages.
The use of automated software or computer programs to vote in connection with this Contest is prohibited and any individual who uses or attempts to use such methods in connection with this Contest will be disqualified. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with this Contest, and reserves the right, in its sole discretion, to cancel, terminate or suspend this Contest should any virus, bug, bots, unauthorized human intervention, or other causes beyond Sponsor’s control corrupt or otherwise affect the administration, security, fairness or proper conduct of the Contest. Votes perceived by K'NEX to have been entered via bots, or by automated or other artificially initiated means or methods, or with the inferable intent to disrupt the contest, or skew talley results, may be removed from tallies, at the sole timing and discretion of K'NEX. CAUTION: Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of this Contest is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to disqualify and/or seek damages from any such entrant to the fullest extent permitted by law. Sponsor also reserves the right, in its sole discretion, to disqualify any entrant from any other promotion conducted by Sponsor, now or in the future, if entrant’s fraud or misconduct affects the integrity of this Contest.

13. IDEAS BUILT WITH EXISTING K’NEX PIECES AND COMPONENTS:
Entries, including entries related to a new construction, toy or other item (the “Device”), must be constructed exclusively using existing K’NEX parts and sets (string and rubber bands are not allowed, nor are pieces from other manufacturers’ construction toy systems, decorative lighting, signage, etc.). All entries and submitted materials become the exclusive property of K’NEX, and will not be returned. The Entrant (Designer/Inventor), by her/his parent/guardian, acknowledges and agrees that by submitting this entry, she/he hereby transfers and assigns all rights in the Device under any copyright, patent or other intellectual property laws to K’NEX. K’NEX may illustrate the Device in its catalogs, instruction books, on the K’NEX website, www.knex.com, or in any other media now known or later invented, and may otherwise inform its customers and potential customers of the Device, whether or not entrant is selected as a Semi-Finalist, Finalist or Grand Prize winner. K’NEX, and any parent, subsidiary, affiliated or successor entities, and any of its or their present or future customers, may construct and use the Device without any further authorization and without any payment or royalties of any kind to Entrant (Designer/Inventor).
A note to Parents/Guardians, and request for their consent: As you know, by entering this Contest, your child/ward would like to become a member of the K’NEXpert Panel, which requests that they be an active member for a term of no more than a year. By participating in this panel, we will provide the child a personal Photo Gallery page at www.knex.com, which K’NEX will update throughout the year with pictures and descriptions of additional K’NEX creations as supplied by the K’NEXpert.
By clicking above, I certify that I am the parent/legal guardian of the entrant, that my child/ward is the designer/inventor, and sole creator of the submitted entry, that she/he is eligible to participate, and that I have read and understand the Official Rules, entry form, and this waiver, and agree to be bound by them. I further agree that if my child/ward is selected as a winner I will promptly execute and deliver all additional waivers and releases in accordance with the Official Rules required to receive the prize, and understand that failure to do so will result in forfeiture of the prize.
